Buying property in Tunisia: ownership, register, deposit.

Three questions decide whether anything else matters: can you own it, does the register hold, and is your deposit protected. Here are the answers for Tunisia, each with the law or source it rests on. The answers are written for EU and EEA citizens; where rules differ for other nationals, the ownership answer says so. As of September 2026.

The core answers

Can you buy property here as an EU citizen?

Yes, but subject to permission: the purchase requires the prior consent of the governor of the gouvernorat in which the property lies. Only land in industrial and tourism zones is exempt, and only where it serves an economic project. Agricultural land cannot be acquired at all - the statute lists those entitled to acquire it exhaustively, and foreigners are not among them; what remains for them is a lease.

Legal basis for agricultural land: Loi 69-56 of 22 September 1969, Art. 1er as amended by Loi 97-33 of 26 May 1997, statutory text via faolex.fao.org. On the permission requirement: Décret of 4 June 1957 on property transactions, Art. 7, extended by Loi 2005-40 of 11 May 2005 - the text of the decree itself is not publicly available; that it remains in force is evidenced by the guide issued by the ministry for industry and energy, energiemines.gov.tn

Is your deposit protected by law?

Yes, and more strictly than in the neighbouring countries. Before the preliminary contract is signed the developer may accept nothing at all - no payment, no deposit, no subscription. Advance payments after that are permitted only against a bank or insurance guarantee in favour of the buyer. What is not prescribed is a payment schedule tied to construction progress; the instalments run by calendar. Developers need an approval from the ministry, and the list is public - a specific developer can be checked against it.

Legal basis: Loi 90-17 of 26 February 1990, Art. 9 to 16, Art. 12 as amended by Loi 2009-62 of 31 July 2009, verbatim "une caution bancaire ou une caution délivrée par une société d'assurance". Evidenced by a publication of the Ministère de l'Équipement et de l'Habitat, mehat.gov.tn. List of 3,296 approved companies, as at 10 July 2026: mehat.gov.tn

Land register and deed

Entry in the titre foncier is constitutive: without it no ownership arises, not even between buyer and seller, only a personal obligation against the seller. In rural areas roughly 82.5 per cent of the land eligible for registration is recorded; for the remainder there is only a certificate de possession, and that is not registered ownership. The deed of sale may be drawn up solely by the Conservation de la Propriété Foncière, a notary or a practising lawyer - any other author renders it absolutely void.

Legal basis: Code des droits réels, Art. 373 and Art. 377 bis; certificat de possession under Loi 74-53 of 10 June 1974. On the cadastre, the Office de la Topographie et du Cadastre, otc.nat.tn. Residence

Property creates no right of residence and does not make the application easier either. Three months are possible without a visa. A permit becomes mandatory beyond three consecutive months or six months spread across one year - owners regularly overlook the second limit. The carte de séjour temporaire runs for a maximum of one year; permanent residence requires five years of uninterrupted lawful stay. There is no visa tied to an investment amount.

Legal basis: Loi 68-7 of 8 March 1968, Art. 7, 9, 10 and 13; Décret 68-198 of 22 June 1968, Art. 7 and 30 to 36. Statutory texts via legislation-securite.tn

Purchase costs and the route the money takes

The registration duty is 5 per cent, plus a 1 per cent entry fee. For non-resident buyers who pay for a built residential property demonstrably in foreign currency, the registration duty drops to a flat 30 dinars per page. That same proof of foreign-currency payment also decides whether the net sale proceeds may later be transferred abroad freely. Anyone paying in cash or in dinars from local sources has no right of transfer and needs an individual permit from the minister of finance.

Legal basis: Code des droits d'enregistrement et de timbre, Art. 20 no. 1 and Art. 23 I no. 12 septies. On exchange control, Code des changes, Loi 76-18 of 21 January 1976, Art. 1er, and Décret 77-608 of 27 July 1977, Art. 20 and 21 - text via the central bank, bct.gov.tn

What to check in Tunisia

Three points decide it, and all three are binary. First: does a numbered titre foncier exist for the plot, or is there only a certificat de possession? Second: is the governor's permission written into the preliminary contract as a condition precedent, or is it to follow later? Third: will the Tunisian bank issue a certificate for the foreign currency brought in? When buying from a developer, add the guarantee under Art. 12 - it is always prescribed, but it is produced only on request.

First thing to check

  • Whether the purchase price can demonstrably be brought in as foreign currency through a Tunisian bank. That single piece of evidence decides the tax burden, the need for permission and the later transfer of the proceeds.

Lawyers in Tunisia

These firms have agreed to be named here. There is no partnership, no cooperation agreement and no payment in either direction - neither from me to them nor the other way round. They check title, encumbrances and contract. I check the building and the developer. Each side is instructed directly by the buyer. Being named is not a recommendation in the legal sense and creates no responsibility on the part of those named for my work.

What the guide cannot do

A country can look good in all three columns and the specific property can still be a total loss. The reverse is also true: in a country with a weak register, a cleanly titled plot can be entirely unproblematic. The guide tells you what the environment looks like. Whether this one property holds up is decided by the review.
