Buying property in Argentina: ownership, register, deposit.

Three questions decide whether anything else matters: can you own it, does the register hold, and is your deposit protected. Here are the answers for Argentina, each with the law or source it rests on. The answers are written for EU and EEA citizens; where rules differ for other nationals, the ownership answer says so. As of September 2026.

The core answers

Can you buy property here as an EU citizen?

Full ownership, with no restriction by nationality. Article 20 of the Constitution expressly grants foreigners within the national territory the same civil rights as nationals, including the right to hold, buy and sell real property. The exception is the Zonas de Seguridad de Fronteras, the border security zones: there every property transaction passes through a previa conformidad procedure before the Comisión Nacional de Zonas de Seguridad, and that body's own allocation of competences expressly distinguishes by nationality for rural land.

Legal basis: Constitución Nacional Art. 20 - "Los extranjeros gozan en el territorio de la Nación de todos los derechos civiles del ciudadano; pueden ... poseer bienes raíces, comprarlos y enajenarlos" (argentina.gob.ar, retrieved 19.10.2026) · Decreto-Ley 15.385/1944 and Resolución 219/1997 of the Comisión Nacional de Zonas de Seguridad (argentina.gob.ar, retrieved 19.10.2026)

Is the register reliable?

Ownership does not arise upon registration. Under Article 1892 of the Código Civil y Comercial an acquisition between living persons requires both título suficiente, the notarial escritura pública, and modo suficiente, the handover of possession. Entry in the province's Registro de la Propiedad Inmueble has external effect under Article 1893: without sufficient publicity the acquisition cannot be asserted against interested third parties acting in good faith. The register is therefore declaratory, not constitutive, and it is kept by province rather than nationally.

Legal basis: Código Civil y Comercial Art. 1892 and 1893 (infoleg.gob.ar, retrieved 19.10.2026) · Ley 17.801 of 28 June 1968, Boletín Oficial No. 21473 of 10 July 1968 (argentina.gob.ar, retrieved 19.10.2026)

Is your deposit protected by law?

No, not since 13 November 2024. Until then Article 2071 of the Código Civil y Comercial required, for contracts on built or planned units under the condominium regime, mandatory insurance in favour of the buyer against failure of the project. Decreto 1017/2024 replaced the provision: the owner may now provide such insurance - "podrá constituir un seguro" - as agreed between the parties. Securing a deposit is therefore purely a matter of contract. The requirement of an escritura pública is unaffected.

Legal basis: Código Civil y Comercial Art. 2071, replaced by Art. 14 of Decreto 1017/2024, Boletín Oficial of 13 November 2024 (infoleg.gob.ar, retrieved 19.10.2026)

Residence

Property creates no right of residence. Article 23 of Ley 25.871 provides the temporary categories rentista - a person who funds their stay from their own means brought in from abroad or from the income those means produce - and inversionista, a person who contributes their own assets to activities of interest to the country. Both are granted for up to three years and are renewable. The required minimum amounts are set by disposition of the Dirección Nacional de Migraciones; which amount applies today is an open point.

Legal basis: Ley 25.871 Art. 23 lit. b and lit. d (infoleg.gob.ar, retrieved 19.10.2026)

First thing to check

  • Whether the escritura pública exists and is entered in the province's Registro de la Propiedad Inmueble - and whether the plot lies within a Zona de Seguridad de Fronteras. If it does, the previa conformidad of the Comisión Nacional de Zonas de Seguridad has to be obtained before the purchase.

What the guide cannot do

A country can look good in all three columns and the specific property can still be a total loss. The reverse is also true: in a country with a weak register, a cleanly titled plot can be entirely unproblematic. The guide tells you what the environment looks like. Whether this one property holds up is decided by the review.
